Terms of Service for Aussie Christmas Lights

1. Acceptance of Terms

By downloading, installing, or using Aussie Christmas Lights (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

Aussie Christmas Lights is a community-driven mobile application that allows users to:

Discover Christmas light displays across Australia
Add and manage their own Christmas light displays
Upload photos of displays
Save favourite displays
Plan routes to visit displays

3. User Accounts

3.1 Account Creation

You may browse displays without creating an account
To add displays, upload photos, or save favourites across devices, you must sign in with Apple
You must be at least 13 years old to create an account

3.2 Account Responsibility

You are responsible for maintaining the security of your account
You are responsible for all activities that occur under your account
You must notify us immediately of any unauthorised use of your account

4. User Content

4.1 Content You Submit

“User Content” includes any photos, text, display information, or other materials you submit to the App.

4.2 Licence Grant

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, display, and publish your User Content in connection with operating and providing the App. This licence continues even if you stop using the App, but you may delete specific content at any time.

4.3 Content Ownership

You retain ownership of your User Content. We do not claim ownership of any content you submit.

4.4 Content Representations

By submitting User Content, you represent and warrant that:

You own the content or have the right to submit it
The content does not infringe any third party’s intellectual property rights
The content does not violate any laws
The content is accurate and not misleading
You have permission to photograph and share images of properties you submit

4.5 Photo Guidelines

When uploading photos:

Only upload photos you have taken yourself or have permission to use
Do not upload photos containing people without their consent
Do not upload inappropriate, offensive, or illegal content
Photos should be relevant to Christmas light displays

5. Acceptable Use

5.1 You Agree Not To:

Submit false, misleading, or inaccurate display information
Upload inappropriate, offensive, or illegal content
Harass, abuse, or harm other users
Impersonate any person or entity
Use the App for any unlawful purpose
Attempt to gain unauthorised access to the App or its systems
Interfere with or disrupt the App’s operation
Submit spam or unsolicited content
Use automated systems to access the App without permission
Circumvent any rate limits or security measures

5.2 Display Listings

When adding a display:

You must have the right to list the property (owner or with owner’s permission)
Address and location information must be accurate
Operating hours and status must be kept up to date
You must remove or deactivate listings that are no longer active

6. Content Moderation

6.1 Our Rights

We reserve the right to:

Review, edit, or remove any User Content at our discretion
Suspend or terminate accounts that violate these Terms
Report illegal content to appropriate authorities

6.2 Reporting

Users may report inappropriate content or behaviour. We will review reports and take appropriate action.

6.3 No Obligation to Monitor

While we may moderate content, we are not obligated to monitor all User Content and are not responsible for content submitted by users.

7. Intellectual Property

7.1 App Ownership

The App, including its design, features, and functionality, is owned by Cody Media Design and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

7.3 Restrictions

You may not:

Copy, modify, or distribute the App
Reverse engineer or attempt to extract the source code
Remove any copyright or proprietary notices
Use the App’s content for commercial purposes without permission

8. Third-Party Services

The App uses third-party services including:

Apple CloudKit for data storage
Apple MapKit for maps
Sign in with Apple for authentication
Firebase for account management

Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimers

9.1 Service Provided “As Is”

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Guarantee of Accuracy

We do not guarantee the accuracy, completeness, or reliability of any display information, including:

Display locations and addresses
Operating hours and dates
Photos and descriptions
Current status of displays

9.3 User Verification

We do not verify the identity of users or the accuracy of their submissions. Visit displays at your own discretion.

9.4 Availability

We do not guarantee that the App will be available at all times or that it will be error-free.

10. Limitation of Liability

10.1 No Liability for Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of data
Loss of profits
Personal injury or property damage
Any damages arising from your use of the App

10.2 Maximum Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP (WHICH IS $0 FOR FREE APPS).

10.3 Essential Purpose

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless Cody Media Design and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the App
Your User Content
Your violation of these Terms
Your violation of any rights of another party

12. Account Termination

12.1 Termination by You

You may delete your account at any time through the App’s settings.

12.2 Termination by Us

We may suspend or terminate your account at any time, with or without cause, with or without notice, including if we believe you have violated these Terms.

12.3 Effect of Termination

Upon termination:

Your right to use the App ceases immediately
We may delete your account data
Provisions that should survive termination will remain in effect

13. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by:

Updating the “Last Updated” date
Posting a notice in the App

Your continued use of the App after changes constitutes acceptance of the new Terms.

14. General Provisions

14.1 Governing Law

These Terms are governed by the laws of Australia. Any disputes shall be resolved in the courts of Australia.

14.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

14.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.4 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

14.5 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
